United Time Group LLC, a Delaware corporation d/b/a Ashford.com ("Ashford") has created this privacy policy (this “Policy”) to demonstrate our firm commitment to the privacy of the personal information of our visitors, customers, applicants, and employees. Ashford is committed to respecting your need for appropriate protection and management of the information you share with us. The purpose of this Policy is to describe the personal information we may collect from you, the purposes for which we collect it, how we use it, and when we may share it with third parties. This Policy also describes the choices you can make about how we collect, use and disclose your information. Ashford will not collect, use, or disclose your personal information other than in compliance with this Policy.

By using the www.ashford.com (the “Website”) and/or making online purchases of products, you agree to the terms and conditions of this Policy. If our Policy changes substantively in the future, we will notify our customers and Website users of any such changes by posting an updated Policy on our Website.

Following the posting of such changes, your continued use of the website will constitute your acceptance of these changes, and you will be bound by such changes. What kind of information do we collect?

We may collect personal information from you when you send, disclose, or otherwise provide your personal information to us such as by setting up a user account and password, logging in as a registered user of, searching for a product, making an order for a product, providing information in your account (and you might have more than one, if you've used more than one e-mail address when shopping with us), interacting with us by phone, e-mail, or through our websites, mobile optimized websites, mobile applications or otherwise or if you complete an entry form to participate in a contest, promotion or survey, whether online or any brick and mortar location, if applicable. Genetic, physiological, behavioral, and biological characteristics or activity patterns used to extract a template or other identifier or identifying information, such as fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data.

F. Internet or other similar network activity.

Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement.

G. Geolocation data.

Physical location or movements.

H. Sensory data.

Audio, electronic, visual, thermal, olfactory, or similar information.

I. Inferences drawn from other personal information.

Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

J. Sensitive personal information

Sensitive information means a consumer’s social security, driver’s license, state identification card, or passport number; account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; precise geolocation; racial or ethnic origin, religious or philosophical beliefs, or union membership; the contents of a consumer’s mail, email, and text messages unless the business is the intended recipient of the communication; genetic data; the processing of biometric information for the purpose of uniquely identifying a consumer; citizenship or immigration status; personal information collected and analyzed concerning a consumer’s health; and personal information collected and analyzed concerning a consumer’s sex life or sexual orientation

Depending on the applicable jurisdiction, certain categories of information may be included from the definition of personal information. For example, under the California Consumer Privacy Act (CCPA), personal information does not include categories of personal information, such as: (i) publicly available information from government records; (ii) deidentified or aggregated consumer information; (iii) personal information that is collected, processed, sold, or disclosed pursuant to the federal Gramm-Leach-Bliley Act (Public Law 106-102), and implementing regulations, the California Financial Information Privacy Act (Division 1.4 (commencing with Section 4050) of the Financial Code), or protected health information that is collected, processed, sold, or disclosed pursuant to the federal Health Insurance Portability and Accountability Act, and implementing regulations.

We retain your personal information for as long as necessary to provide you products and services and maintain our business relationships, and in accordance with Ashford’s data retention schedule, unless we have or deidentified or deleted your personal information in response to a request to delete. We may retain your personal information for longer if it is necessary to comply with our legal obligations or reporting obligations, resolve disputes, collect payment or as permitted or required by applicable law. We may also retain your personal information in a deidentified or aggregated form so that it can no longer be associated with you. To determine the appropriate retention period for your personal information, we consider various factors such as the amount, nature, and sensitivity of your information; the potential risk of unauthorized access, use or disclosure; the purposes for which we process your personal information; applicable legal requirements.

Purposes for Collection and Use of Personal Information

We may collect or use the personal information for one or more of the following purposes:

  • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to ask a question about our products or services, we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a service, we will use that information to process your payment and facilitate delivery.
  • To contact you and/or provide you with email alerts and other notices concerning our products, services, events, or news that may be of interest to you. For example, we may send you announcements, surveys, and newsletters using any communications preferences you have expressed. For example, we engage our advertising partners, including third party advertising companies and social media companies, to display ads around the web. DO WE DISCLOSE YOUR INFORMATION WITH THIRD PARTIES?

We do not sell or share your personal information to third parties. We also do not use or disclose your sensitive personal information for purposes that, with limited exceptions, are not necessary in order to provide our products and services and are reasonably expected by an average consumer requesting those goods and services. As the Company does not sell your data, the Company does not have actual knowledge that we have sold personal information of minors under age 18.

However, in the event of a sale of all or substantially all of our business or another similar transaction, we may transfer or disclose your personal information to a purchaser or prospective purchaser, who may collect, use and disclose such information for the purposes of evaluating the proposed transaction or operating and managing the affairs of the acquired business, or for other purposes identified in this Policy. In the unlikely event of Ashford's bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, Ashford may not be able to control how your personal information is treated, transferred, or used.

We may, however, disclose your personal information with services providers and contractors who help us provide the products and services, such as, payment processing, marketing and advertising, email, text and other communications, applications, business support, and website, software, platform, cloud, data storage and other technical services.

We may also disclose your personal information if necessary to: (1) comply with federal, state, or local laws; (2) comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities; (3) cooperate with law enforcement agencies concerning conduct or activity that we reasonably and in good faith believe may violate federal, state, or local laws; or (4) initiate or defend legal claims.

Lastly, we may transfer to a third-party personal information as part of a merger, acquisition, bankruptcy, or other transaction in which the third party assumes control or acquires of all or part of the assets of our business.

Web Beacons), tracking pixels or similar devices, which are used to track the online usage patterns anonymously (i.e., in a non-personall0yidentifiable manner). In addition, Ashford may also use these devices in HTML-based emails sent to users to track which emails are opened by recipients. The Website is directed for use by adults. Ashford does not knowingly collect any personal information from children under the age of 18. Those under age 18 should not use Website or provide Ashford with any personal information.

We reserve the right to disclose your personal information as required by law, in response to legal process and law enforcement requests.

Our Website may contain links to websites operated by third parties. These websites may collect your personal information. This Policy does not apply to the practices of third parties and we do not assume any responsibility for, and by using this Website and/or accessing a third party's website from this Website you release Ashford, and its members, employees, agents, officers and directors, of any responsibility for, the actions, practices, and omissions of third parties.   • Right to Confirm:

You may have the right to confirm whether or not we process your personal information.

  • Right of Correction: You may have the right to request that we rectify any inaccurate or incomplete personal information that we hold about you. ·       Opt-Out of Profiling: You may have the right to opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects, including automated decisions.

·       Opt-Out of Sale: We do not currently sell the personal information of its consumers.  However, if we do sell any personal information, you may also have a right to opt-out of certain personal information sales. 

Important: The exact scope of these rights vary by state. There are also several exceptions where we may not have an obligation to fulfill your request.

To exercise any of these rights, please email customerservice@ashford.com. Upon receiving your request, we will need to verify your identity to determine you are the same person with whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with the information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Non-Discrimination

The Company will not discriminate against you for exercising any of your privacy rights. Exercising your rights will not result in denial of services, reduced quality of services, or different pricing.

HOW IS PERSONAL INFORMATION SECURED?

No system for safeguarding personal or other information is 100% secure. We have adopted appropriate measures to ensure the confidentiality of personal information and to safeguard personal information against loss or theft, as well as unauthorized access, disclosure, copying, use or modification, in light of, among other things, the sensitivity of the information and the purposes for which it is to be used.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with proper encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we adhere to generally accepted industry standards.

MOBILE PRIVACY

When you use our mobile optimized website or our mobile application, we may receive information about your location and your mobile device, including a unique identifier for your device. Ashford and our service providers may use and store this information to provide you with location-based services, search results, and other personalized content. We will provide notifications only to those customers who accept to receive such notifications. Most mobile devices allow you to control or disable location services in the device's setting's menu. If you have questions about how to disable your device's location services, we recommend you contact your mobile service carrier or the manufacturer of your particular device.

CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the Website. If we make material changes to this Policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
